01Who this agreement is with
Pactling Academy is operated by Adam Wachter, an individual based in Taiwan. In this agreement, “we,” “us,” and “our” refer to Adam Wachter operating Pactling Academy. The service is available at https://pactlingacademy.com. Contact us at support@pactlingacademy.com.
“You” means the adult accepting this agreement for their own educator account, or the school or other educational organization they are authorized to represent. An authorized school representative accepts for that organization. Staff must follow the account and use rules applicable to their access.
Students use educator-managed student logins. They are participants, not purchasing customers or administrators, and do not independently register adult accounts or accept this agreement on behalf of a school or family. Student privacy rights are unaffected by this distinction.
02Eligibility and acceptance
You must be at least 18 and legally able to enter this agreement. You must provide accurate registration details, verify your email when required, and have permission to use the service for the students you enroll. A pilot invitation or account approval does not establish authority to represent a school or authorize a child’s participation.
The current pilot is offered without a subscription fee to approved teachers and schools, initially in Taiwan. Access is subject to approval and the features and limits communicated for your account. Ask us before enrolling an institution or students outside the approved pilot scope.
By creating an adult account through a registration form that links to this agreement, you agree to this version. If you do not agree, do not create the account or enroll students. For accounts created under earlier pilot terms, those earlier terms continue to apply until changes are separately notified and any required agreement is obtained. Publishing or viewing this page does not by itself record acceptance of a new version or supply permission for student participation.
03Accounts and school administration
A school owner can register a school from the main site and manage its workspace. The owner may invite other adults as administrators or teachers. Each adult must use their own login. Do not share the owner password as a way to give helpers access.
Owner and administrator access alone does not use a teacher seat. An owner or administrator who is also assigned to teach uses a teacher seat under the account’s allowance. A role grants only the permissions provided for that role; it does not grant access to other schools or personal workspaces.
The school is responsible for appointing authorized staff, reviewing their access, and removing access when their duties change or end. School records remain in the school workspace when a staff member leaves. The owner must arrange an authorized ownership transfer before closing the owner account. Contact us if the owner cannot complete a transfer; we may require evidence of authority.
Joining a school does not by itself transfer a personal classroom or its records into that school. Administrative control of a workspace does not determine copyright ownership or remove students’ or families’ rights in their information.
Keep passwords, student access codes, and recovery details confidential. Report suspected unauthorized access promptly. Adult accounts may be limited to one active sign-in session, and a new sign-in may end the previous session. Do not use shared credentials to bypass access or seat limits.
04Student participation and home practice
Before adding students, confirm your authority, provide the required privacy information, and obtain any school approval and parent or guardian authorization required for the intended use. This includes classroom activities, optional home practice, and features that display names, avatars, game progress, or achievements to classmates or on a classroom projector. Explain these uses in language the relevant families can understand.
Use only the student information needed for the activity. Prefer first names or suitable nicknames where possible. Do not upload identity documents, medical records, private family information, or other sensitive material that the service does not need.
You decide which activities, lessons, classroom powers, and rewards are appropriate for your students. Explain conduct expectations and make suitable arrangements for accessibility and participation. Do not use game outcomes to deny essential learning, reasonable accommodations, or basic student needs.
Home practice remains part of the educator’s chosen learning activity. It is not a childcare, emergency, or continuous monitoring service. Coordinate appropriate access and use with families. Our obligations under applicable privacy, security, and other laws remain our responsibility; your acceptance does not transfer them to you.
05Lessons and other content
You and the relevant rights holders keep your rights in lessons, worksheets, vocabulary, uploaded images, and other material you provide. You must have permission to upload that material and share it with the intended recipients. Copyright, privacy, and confidentiality requirements still apply to classroom materials.
You grant us a non-exclusive, royalty-free permission to host, copy, process, and display that material only as reasonably needed to operate the service for you, deliver your chosen sharing features, provide support, maintain security, and meet legal obligations. This permission applies wherever our disclosed service providers process the material. Our contracted providers may use it only as needed for those purposes under their applicable arrangements.
This permission does not authorize selling student information, advertising to students using their information, or using private classroom material in public marketing. We would need separate appropriate permission for a testimonial, public student example, or other promotional use.
School workspace material may remain available to authorized school staff after its uploader leaves, subject to the school’s rights and deletion obligations. After deletion, our permission continues only for lawful retention, backup expiry, and other processing described in the Privacy Notice. You can report suspected copyright or privacy violations to support with enough detail to identify the material.
06Optional AI and external services
AI assistance is optional. If you connect your own supported AI account or API key, the provider’s separate terms, data practices, and charges apply to that connection. You are responsible for authorizing its use and monitoring the charges on your provider account.
Check the material selected for generation before sending it. Remove unnecessary student identifiers and confidential information, and ensure you have permission to send the remaining material to that provider. Connecting AI is not blanket permission to send student records.
Review generated stories, questions, answers, and vocabulary before assigning them. AI can produce incorrect, unsuitable, biased, or unoriginal material. It does not replace your judgment about accuracy, age suitability, copyright, or learning needs. We do not promise that generated output will be correct or exclusively yours.
You may disconnect an integration and should revoke a compromised key with its provider. Disconnecting does not undo processing already completed by that provider. Our handling of connection details and selected materials is explained in the Privacy Notice.
07Game features and virtual rewards
Pactlings, gold, experience points, items, outfits, decorations, and similar rewards are features for classroom engagement and practice. They have no cash value, cannot be redeemed for money, and do not give ownership of our artwork or software. Students cannot make purchases through their student logins. Do not sell accounts, credentials, or in-game rewards.
Classroom powers represent privileges that the educator enables and approves. A student’s in-game unlock does not require an educator to grant an unsafe, inappropriate, or unavailable privilege. Explain any classroom conditions fairly and clearly.
We may rebalance game rules, correct errors or duplicated rewards, and change features as the pilot develops. We will communicate substantial changes affecting ordinary use where practicable. Scores and repeated practice can help educators understand participation, but they are not a guarantee of mastery, a formal grade, or a diagnosis.
08Acceptable use and our materials
Use the service for authorized educational activities. Do not harass or exploit others, impersonate another person, upload unlawful or age-inappropriate content, disclose another person’s private information without authority, distribute malware, or interfere with the service.
Do not access another account or school without permission, bypass access restrictions, manipulate rewards through exploits, or automate requests in a way that disrupts normal use. Report a suspected vulnerability privately to support and avoid accessing or retaining other people’s information.
We permit you and your authorized students to use the service and its supplied artwork and software for its intended activities while your access remains valid. Pactling Academy branding, artwork, code, and other service materials remain ours or their respective rights holders’. Do not extract, resell, or redistribute those materials as a separate product without permission. This does not restrict uses that applicable law permits regardless of this agreement.
09Privacy and requests about data
Our Privacy Notice at https://pactlingacademy.com/privacy explains the information processed, purposes, recipients, international processing, retention, and ways to exercise rights. Read it before creating student records. Accepting this agreement is not consent to every possible use of personal information and does not waive anyone’s statutory rights.
Teachers and school administrators should assist with legitimate requests concerning their workspace. Students and families may also contact support@pactlingacademy.com directly. We may verify identity and authority proportionately and coordinate with the responsible educator without disclosing unrelated students’ records.
A school may need an additional written data-processing agreement. Any such agreement must be expressly agreed with us; this general agreement is not a substitute for a complete school data-processing schedule.
10Pilot availability and future charges
The pilot is still being developed. Bugs, maintenance, interruptions, and feature changes may occur. We will use reasonable care in operating the service, but do not promise uninterrupted access, a specific learning result, or the permanent availability of a particular game or reward.
Keep independent copies of important teaching materials and records you are required to retain. Backups support recovery but do not guarantee restoration of every item or serve as a permanent school archive. Report material errors so we can investigate.
The current pilot has no subscription fee. If paid plans are introduced, we will explain the price, billing period, any automatic renewal, cancellation, refund rules, and applicable taxes before requesting agreement to charges. Participation in the free pilot does not authorize future billing.
11Leaving and account closure
You may stop using the service and use the available closure controls or contact support. Removing a student from a class, archiving a class, deleting a record, and closing an account have different effects. Check the confirmation shown before proceeding. Archive retains records; it does not erase them.
Leaving a school or deleting a personal staff account does not automatically delete records controlled through the school workspace. Coordinate retention, staff handover, and authorized deletion with the school. A school owner must resolve ownership transfer or school closure before deleting the owner account.
Active records, retained records, and backups are handled according to the Privacy Notice and applicable law. Limited records may be retained for security, legal obligations, disputes, or preventing a backup restore from recreating erased accounts. We will explain applicable restrictions on a deletion request. Deletion is not a promise that every provider’s recovery copy disappears immediately.
12Suspension and service closure
We may restrict access where reasonably needed to address unauthorized access, serious misuse, an immediate security or safety risk, legal requirements, or failure to meet pilot eligibility. We will explain the reason and allow a reasonable chance to resolve it where appropriate. We may act first where delay would create a material risk or the law restricts notice.
Contact support if you believe a restriction is mistaken. We will review the available information. A restriction does not itself remove a person’s right to request their data. We will assess requests for access, correction, or deletion subject to security, authority, and legal requirements.
If we plan to end the pilot or close the service, we will give reasonable advance notice where practicable and explain how to request available records and arrange closure. Immediate closure may be necessary for a legal requirement or serious security risk.
13Responsibility and legal rights
Each party remains responsible for its conduct and obligations under applicable law. You are responsible for the educational decisions, permissions, and material you provide; we remain responsible for operating the service and handling information in accordance with our own obligations.
Nothing in this agreement excludes liability for fraud, intentional misconduct, gross negligence, or another liability that cannot lawfully be excluded or limited. Nothing removes mandatory consumer or personal-data rights. The pilot limitations described above do not override those protections.
14Governing law and resolving concerns
Taiwan law governs this agreement, subject to mandatory rights and laws that cannot be displaced by contract. Courts with lawful jurisdiction may hear a dispute; this clause does not impose an exclusive court or require private arbitration.
Please contact support@pactlingacademy.com so we can try to resolve a concern. Contacting support is not a condition for exercising a statutory right, making a regulator complaint, or seeking urgent legal relief.
15Changes to this agreement
We will identify the version and effective date of the published agreement. For material changes, we will provide reasonable advance notice through the service or the adult account’s contact email and request renewed acceptance where required. Urgent legal or security changes may require shorter notice; we will explain them as soon as reasonably possible.
A new version does not retroactively change the rules for an existing dispute or turn earlier processing into authorized processing. If you do not accept a required change, contact us about discontinuing use and handling the affected records. No change removes rights that the law protects.
